Provisions for customer accounts

Liability, compensation

In the event of injury to life, body or health caused by an intentional or negligent breach of duty by Live Nation, or an intentional or negligent breach of duty by one of its legal representatives or agents, Live Nation shall be liable in accordance with the statutory provisions.

The following applies to other damage:

For damage caused by a grossly negligent breach of duty by Live Nation, or by an intentional or grossly negligent breach of duty by one of its legal representatives or agents, Live Nation shall be liable in accordance with the statutory provisions.
For damage caused by a breach of material contractual obligations as a result of ordinary negligence on the part of Live Nation, its legal representatives or agents, Live Nation’s liability shall be limited to the foreseeable damage typical for the contract.
Claims for compensation for other damage as a result of the breach of ancillary obligations or non-material obligations are excluded in the event of ordinary negligence.

The exclusions or limitations of liability do not apply if Live Nation has fraudulently concealed a defect or has given a written guarantee of quality. The provisions of the German Product Liability Act remain unaffected.

Your claim to reimbursement of futile expenses in the place of a claim to compensation in lieu of performance shall remain unaffected within the scope of the above provisions.

Breaches of duty by third parties

Live Nation accepts no liability beyond that set out in clause 7 for the actions, omissions or other conduct of any third-party users on this Live Nation Website.

Live Nation may also provide links to other websites or resources. You hereby acknowledge and agree that Live Nation is not responsible for the availability of such external websites and resources. Live Nation also does not endorse and is not responsible or liable, directly or indirectly, for the privacy practices or the content of such external websites or resources. Live Nation is not responsible for the products, services or other actions and omissions at the venue, insofar as they are beyond Live Nation’s control.

Nevertheless, users may inform Live Nation in writing of misconduct by other users, advertisers or other contractors of Live Nation. Live Nation reserves the right, but has no obligation, to investigate such allegations and take appropriate action at its sole discretion.

Intellectual property

The content of this Live Nation Website, in particular the Live Nation and Rolling Loud logos and the Live Nation design, as well as all other trademarks, logos and illustrations (artwork) on this Live Nation Website, are protected by copyright as registered or used trademarks or other property rights of Live Nation and its business partners. Applicable law

The law of the Federal Republic of Germany shall apply exclusively to the exclusion of German International Private Law (IPR) and the UN Convention on Contracts for the International Sale of Goods (CISG).

Final provisions

Should individual or multiple aspects of these General Terms of Use be or become invalid, this shall not affect the validity of the General Terms and Conditions or the validity of the rest of the contract.
